SSS Maternity Benefit and Separated Status

   Where can I file a complaint against my employer? I cannot yet file my MAT2 maternity benefit claim because my contributions have not yet been posted.

   They have shown me payment receipts, but they have not filed them with SSS. I gave birth on Dec 29, 2013 and then I left the company on April 15. I went to SSS, and they told me to submit 3 requirements: L501 and Certificate of No Advancement of Maternity Benefit. I already  have one, the COE.

If I pay as Voluntary, since I'm now currently unemployed, am I still required to submit L501 and the other documents?

Answers:

1.  Where can I file my complaint against my employer?

   If you finally decide to file a complaint against your former employer, file your complaint at SSS Diliman. Submit an Affidavit describing your situation, your claim and your employer's actions. Bring relevant documents.

But it is much better to resolve your problem first with your employer before filing a complaint.

2.  My contributions have not been posted.

You said you gave birth in Dec 2013, so your semester of contingency is July to Dec 2013. SSS will look for your 6 highest salary credits within July 2012 to  June 2013.  This means that even if your 2014 contribuitions have not yet been posted, then you can file your MAT2.  Anyway, what SSS will look for are your contributions within the 12-month period from July 2012 to June 2013.

3.  They told me to submit 3 requirements:

  File L501, Certificate of Separation with date of Separation, and Certificate of Non-Advancement of Maternity Benefit.   COE is different from Certificate of Separation.  The title of the certificate should be Certificate of Separation from Employment.  It shows your name, your employer and your date of separation.

4. Can I file my MAT2 as Voluntary so I don't need to submit the 3 requirements?

Whether you file as Separated or Voluntary, you are still required to submit the 3 requirements because your Date of Delivery and Date of Separation are within 6 months of each other.  The SSS guide mentions 6 months, but many SSS officers still require these 3 documents even if the gap is already more than 6 months but still less than 1 year.

    Hi po Ms. Jk I was AWOL last december 7,2014 so my employer did not give me clearance of separation or even COE. my due date is on August 6, 2015. Can I claim my benefits?
    ANSWER:
    Hi Jhamar, if you contributed at least 3 contributions within Apr 2014 to Mar 2015, then you're qualified. Pay at least 1 contribution as Voluntary to SSS so your member status will change from Employed to Voluntary, and you will file your MAT2 documents as Voluntary. File your MAT1 asap and have it received and stamped by SSS.

    can i still have my maternity benefits even if I'm no longer with my company? im giving birth this coming june. can i still process it.

    Hi ivy Angela, if you have paid at least 3 contributions within Jan to Dec 2014, you qualify for maternity benefit. File your MAT1 asap and have it received and stamped by SSS.

  3. Hi Jhamar, the ideal procedure is to file MAT1 as Voluntary after your status has changed to Voluntary, but try paying 1 month as Voluntary and filing MAT1 as Voluntary at the same time. If the SSS officer that checks your MAT1 asks, tell her you're changing to Voluntary and show her your contribution receipt.
    If you have an online SSS account, try if you can file MAT1 asap as Voluntary.

Hi Ms. Jk . i paid January-March 2015 contribution today as voluntary and i'll file my Mat1 on Thursday ,but they said that even my status change into voluntary they still need my clearance of separation from my last employer ..is it possible to still claim my benefits ?? My delivery date is on August 2015 ..thank you !

  6. Hi Ms Jk.. I went to sss today and i filed mat1 ..my status has changed to voluntary , but the officer still need my clearance of separation from my last employer andbi asked if i can file separation affidavit but the officer did'nt agree..my employer said that they don't give me clearance of separation ..is there anyway to still claim my benefits ?? Thakyou

  7. Hi noemi estillana, if officers at a certain SSS branch are not very helpful, submit your documents at another branch.

  8. Hi Jhamar Lamsen, the SSS policy says that they require separation certificates only if the gap between date of separation and date of delivery is less than 6 months. You said you AWOLed Dec 7 and you'll give birth Aug 2015, so the gap is more than 6 months.
    Keep your SSS-stamped-received MAT1, and then later on, after getting your baby's birth certificate, file your MAT2, and see if again they will tell you the same thing about your separation papers. If they tell you the same thing, you can try filing at a different SSS branch, another branch nearest your residence, or at the Diliman branch. Ask others too.

  10. Hi noemi estillana, Jhamar Lamsen and others: SSS advises members to file nearest their residence or workplace, but members are allowed to file at any branch (Source: SSS Primer).

  13. Another question Ms. Jk ..i filed my mat1 here in Marikina and i'm living with my husband ,but i wrote my old address which is taytay,rizal ...can i write my current address on my mat2 ? This will affect in claiming my benefits ? Thankyou..

  14. hi maam ,ask ko lang po kung pano ang pwedeng gawin, last september 2014 nag AWOL po ang wife ko sa company and give birth on Feb 2015,
    kaso nag nag request sya ng required certifcate for MAT 2 sabi ng company ndi daw nila sya mabibigyan kasi AWOL daw nga sya..may iba pa bang way para ma clain nya ang Maternity benifits nya thanks.. :)

  15. hello po im honey, ang situation ko po ay na end of contract po ako jan31,2015.. at sa ngaun my employer na po ako pro hindi pa po ako kinakaltasan dahil under probation po ako ng 5months kc bago pa lang ako sa work, anu po ba dpat kung gawin mg voluntary na lng po ba ako? pra mka claim ng maternity benifits?
    follow up question po jk, or pwede ko po eto ipa notify sa employer ko kahit hindi pa ako hinuhulugan , 3 months na po kc wla hulog.. salamat
    expected ko po manganak ay sa august 21-25

  17. ask ko lang po.if na endo ako sa company nung aug.28.2015 na naka maternity leave pa ako at ni re call ulit nila ako.para mag work same company pa din.kailangan ko pa di ba mag pasa ng cert.of seperation at L501I give birt last july,28.2015. di ko pa kasi ma ipasa yung mat-2 ko sa SSS.

  18. About separation papers, dayanara 10/9/15
    My contract with my company ended aug.28.2015 while on maternity leave. They recalled me to work with them -- the same company. Do I need to pass cert.of separation and L501I. I gave birth last july,28.2015. I haven't passed my mat-2 to SSS.
    ANSWER:
    Hi dayanara, talk with your HR. Because you're currently employed with the same employer, you need to file as Employed. So they will need to sign your MAT2 form. Have your employer enrolled with the Sickness and Maternity Payment Thru Banks program?

  21. Makakatanggap po ba ko ng benefit ? I was hired oct 16 2015 then end march 14 2016 ... I delivered my child was july 18 2016 what should i do?

  22. Nanganak po ako Ja. 2012 is there a possibility na may makukuha pa po ako na maternity benefits kahit na po resign na po ako sa work ko ng 2010. Until when po ba pwede magclaim ng benefits?

    1. Until when puedeng mag-claim?: Within 10 years from date of delivery, puedeng mag-claim. Try filing your claim. Ang maging problem is kung hindi ka nag-file ng maternity notification before giving birth, pero kung hospital ka nanganak, merong chance na ma-approve ang claim mo kahit wala kang notification.

  24. Helow po! Im daisy..3 months palang po ako sa work ko,probitionary contract lang po ako,sa ngayon po buntis po ako 2 months na po..qualified po ba ako sa maternity leave kahit probitionary lang po ako sa work ko?

    1. Hi md uminga: Naireport ka na ba ng employer mo sa SSS? Merong SSS deductions ang payslip mo? Kung ang delivery due date mo is June 2017, dapat meron kang at least 3 monthly contributions within your start of employment up to Dec 2016 para qualified ka to claim.
